These terms and conditions govern the relationship between Solar Panels Dominican Republic and our clients. Please read them carefully.

These Terms and Conditions ("Terms") govern your use of the Solar Panels Dominican Republic website, located at opsenergia.com.do ("Site"), as well as all related services provided by Solar Panels Dominican Republic ("Services").

By accessing or using our Site or Services, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use our Site or Services.

These Terms constitute a legally binding agreement between you and Solar Panels Dominican Republic. We recommend that you carefully read these Terms before using our Site or contracting our Services.

Definitions

For the purposes of these Terms and Conditions:

Use of the Site

You may use our Site only for lawful purposes and in accordance with these Terms. You agree not to use our Site:

  • In any way that violates any applicable national, provincial, or local law or regulation.
  • To exploit, harm, or attempt to exploit or harm minors in any way by exposing them to inappropriate content.
  • To transmit or procure the sending of any advertising or promotional material without our prior written consent.
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm the Company or users of the Site or expose them to liability.

Installation Services

Quotes and Contracting: All quotes provided by Solar Panels Dominican Republic are valid for 30 calendar days from the date of issuance, unless otherwise specified. The contracting of our services is formalized through the written acceptance of the quote by the Client and payment of the agreed deposit.

Availability and Scheduling: Service scheduling is subject to availability. We will make all reasonable efforts to meet agreed installation dates, but we will not be responsible for delays caused by adverse weather conditions, material availability issues, or circumstances beyond our reasonable control.

Changes in Scope of Work: Any changes to the scope of work after acceptance of the quote must be agreed in writing and may result in additional costs and/or time extensions.

Property Access: The Client must provide adequate and safe access to the property so we can perform the contracted services. If access is not provided as agreed, we may charge additional fees for lost time.

Payments and Pricing

Pricing: All quoted prices are in Dominican Pesos (DOP) and include VAT, unless otherwise specified. We reserve the right to modify our prices at any time, but changes will not affect orders for which we have already issued confirmation.

Payment Methods: We accept the following payment methods: bank transfer, credit card, and other methods that may be communicated to the Client. Specific details will be provided in the quote or invoice.

Payment Schedule: Unless specifically agreed otherwise, our standard payment schedule is as follows:

  • 30% as a deposit when accepting the quote and signing the contract.
  • 60% when installation work begins.
  • 10% upon completion of installation and after satisfactory performance testing.

Warranties

Installation Warranty: We guarantee that all installation work performed by Solar Panels Dominican Republic will be free from defects in workmanship for a period of 5 years from the date of completion. This warranty covers the repair or replacement of any defective component due to incorrect installation, at no cost to the Client.

Manufacturer Warranties: All installed equipment is covered by the warranties provided by their respective manufacturers. Typically, these include:

  • Solar panels: 25-year performance warranty and 12-year product warranty.
  • Inverters: 5-10 year warranty, depending on the manufacturer and model.
  • Mounting structures: 10-year warranty against manufacturing defects.

Warranty Exclusions: Warranties do not cover:

  • Damage caused by misuse, abuse, negligence, or unauthorized modifications.
  • Damage caused by extreme weather conditions beyond equipment design specifications.
  • Normal wear and tear of equipment.
  • Problems arising from inadequate maintenance or failure to follow provided instructions.
  • Damage caused by force majeure events, including but not limited to storms, floods, earthquakes, lightning, and hurricanes.

Limitation of Liability

To the fullest extent permitted by applicable law, Solar Panels Dominican Republic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Site or Services.
  • Any changes we may make to the Site or Services, or any temporary or permanent cessation of the Site or any part thereof.
  • The performance of the installed Solar System, provided that such performance is within the parameters specified in the quote and is not the result of defects in installation or equipment.

Intellectual Property

The Site and all its content, features, and functionality, including but not limited to, text, graphics, logos, icons, images, audio clips, videos, technical information, software, and design, are the property of Solar Panels Dominican Republic or its licensors and are protected by Dominican and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic, without regard to its conflict of laws provisions.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms shall remain in force.

Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will attempt to provide at least 30 days' notice before the new terms take effect.

By continuing to access or use our Service after those revisions take effect, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
